AUTOMATIC STAY

A legal provision which temporarily blocks creditors from pursuing debtors regarding the amount that was due from them. Automatic stay takes into effect the moment once a debtor files for bankruptcy. Creditors who reckons to have enough grounds can file a petition to the court in order to remove the automatic stay so that they can resume the collection process. A bankruptcy filed in a bad faith will not lead to an automatic stay. Also, some debts, child support for example, are not stayed.
